1. Parties and Scope
These Terms form an agreement between the user and 上海澜境联数字科技有限公司 (Shanghai Lanjinglian Digital Technology Co., Ltd.) regarding the Linko eSIM website, apps, eSIM plans, digital delivery, installation, use, top-ups and support. Before ordering, users should review these Terms, the specific plan description, Refund & Cancellation Policy, Digital Delivery & Withdrawal Notice, and Privacy Policy.
2. Eligibility
You must have the legal capacity required to enter into this contract. If you are below the age at which you may contract independently under local law, an authorized parent or guardian must lawfully consent or purchase on your behalf. You may not use a false identity, stolen payment method, or another person’s account information without authorization.
3. Services
Linko eSIM offers country, regional and global travel eSIM data plans, with eSIM management, status/usage information and top-ups where supported. Unless expressly stated on the product page, plans are data-only and do not guarantee a phone number, voice, or SMS. Coverage, operator, network type, allowance, validity, activation, hotspot, top-up, APN, breakout route and other SKU-specific rules are governed by the product page and order record.
4. Pre-contract Information and Orders
Before payment, the checkout flow should make available the plan’s main characteristics, total price/currency, applicable taxes where legally required, validity, activation rules, destination, delivery method and material restrictions. The final payment button or equivalent action must clearly indicate that placing the order creates an obligation to pay. An order is formed only when accepted/confirmed by the system. If a plan is unavailable, upstream status has materially changed, or a clear technical/pricing error occurs, we may reject the order and refund any amount already collected.
5. Device Compatibility
Before payment, you are responsible for confirming eSIM support, carrier-unlocked status, and destination network/band compatibility. Failure caused solely by an incompatible device, carrier lock, operating-system limitation, incompatible bands, incorrect configuration, or device malfunction does not automatically constitute a Linko eSIM defect. This does not exclude liability for misleading product information, incorrect compatibility representations, or statutory quality/conformity duties.
6. Payment
Checkout displays only payment methods enabled for the relevant order, currency and region. Payments may be processed directly by third-party payment providers. You are responsible only for the final amount clearly shown before payment and any taxes lawfully required. Unauthorized, fraudulent or materially anomalous transactions may be suspended, cancelled or verified.
7. Digital Delivery
After payment confirmation and successful provisioning, Linko eSIM provides the QR code, SM-DP+ address, activation code or other installation information through the app, secure order page and/or order email. Unless expressly promised on the product page, no absolute fixed delivery time is guaranteed. Payment confirmation, fraud checks, upstream systems, network conditions or events beyond reasonable control may delay delivery.
8. Immediate Performance and Statutory Withdrawal Rights
Where applicable law provides a cooling-off or withdrawal right, Linko eSIM does not use an absolute rule that digital delivery alone automatically eliminates all withdrawal rights. Where the law allows performance to begin before the withdrawal period expires and permits that request/acknowledgment to affect the right of withdrawal, checkout must separately capture the legally required express request and acknowledgment before payment and the order confirmation must retain/provide the relevant record. Any loss, limitation or proportionate payment obligation depends on mandatory local law.
9. Installation and Activation
Install using a reliable internet connection and follow the instructions. Do not repeatedly scan the QR code, delete the eSIM, or reset material network settings before troubleshooting is complete. Validity may start at purchase, installation, first connection to a supported network, or another event depending on the SKU; the applicable Activation Policy controls.
10. Validity and Unused Allowance
Pre-activation validity and post-activation plan validity are separate concepts. After expiry, unused data, voice or SMS generally does not roll over, convert to cash or qualify for a commercial refund unless the product page or applicable law provides otherwise.
11. Top-ups
Only eSIMs expressly marked Top-up/Reloadable may be recharged. A top-up may add allowance, extend validity or add a new period and must be associated with the correct ICCID/eSIM. Availability, timing and cancellation depend on the product rules, order status and applicable law.
12. Coverage and Quality
Connectivity is delivered through destination mobile-network operators and network partners. Coverage, speed, 4G/5G, latency, roaming, operator switching and quality may vary with location, device, bands, congestion, maintenance and local policies. We do not guarantee a fixed network, fixed speed or uninterrupted availability at every location, while remaining responsible for mandatory contractual conformity and consumer remedies where applicable.
13. Acceptable Use
You must not use the Services for fraud, harassment, attacks, unlawful communications, unauthorized resale, abusive bulk use, cracking, circumvention of security controls or serious interference with networks or the Services. Where reasonably justified, we may suspend affected Services, require verification, or terminate an order to protect users, networks and payment security. This does not remove mandatory refund or consumer rights that have already arisen.
14. Support and Troubleshooting
For installation, activation or connectivity issues, you should reasonably cooperate with troubleshooting. We may request order number, ICCID, device model, OS version, error messages, eSIM-setting screenshots, APN/network selection and location at country/region level where reasonably necessary. Avoid deleting the eSIM or destroying material diagnostic evidence before troubleshooting is complete.
15. Refunds, Cancellation and Statutory Remedies
Commercial refunds are governed by the Refund & Cancellation Policy. Unactivated, unused orders that remain cancelable upstream may be canceled. Activated or used orders are not automatically eligible for no-cause commercial refunds. However, a verified service/configuration/upstream defect, or a statutory lack of conformity of digital content/services, may entitle the consumer to applicable remedies such as bringing the service into conformity, reprovisioning/replacement, price reduction, termination, partial refund or full refund.
16. Intellectual Property
The Linko eSIM brand, software, interface, text, graphics, database structure and other protected materials are owned by their lawful rights holders. Unauthorized copying, sale, rental, sublicensing, derivative works or unlawful reverse engineering is prohibited. This does not restrict interoperability, security research or other rights that applicable law expressly makes non-waivable.
17. Limitation of Responsibility
To the extent permitted by law, we are responsible for order processing, digital delivery and support within our reasonable control but do not make an absolute guarantee of permanent third-party network availability, fixed speed, or uninterrupted service at every location or during force-majeure events. No exclusion or limitation applies where liability cannot lawfully be excluded or limited, including fraud, willful misconduct, non-excludable personal injury liability, or mandatory consumer rights.
18. Changes and Termination
We may update these Terms for business, technical, legal or platform-policy changes. Updates for future transactions will be reasonably published. Completed purchases remain subject to the terms in effect at purchase and non-waivable consumer rights unless applicable law allows a change and any required consent is obtained.
19. Governing Law and Disputes
Without depriving consumers of mandatory protections, jurisdiction rights or choice-of-law protections available under the law applicable to them, these Terms are governed by the laws of the People’s Republic of China. The parties should first attempt reasonable resolution through the official support channel. If unresolved, a claim may be brought before a court having lawful jurisdiction. Non-waivable consumer and jurisdictional rules applicable to the user prevail.
